HHP’s father demands his son’s marriage to Sengadi be declared invalid

Lerato Sengadi AND HHPThe father of late rap superstar HHP is turning to the Constitutional Court to challenge problematic uncertainties, unfairness, grey areas, ambiguities and guesswork to which customary marriages are subjected in South African law.

Robert Tsambo has complained to the apex court that the country’s legal system treats customary marriages as variable and flexible and that this is problematic as the same is not applied to civil marriages, which leads to unequal and unfair treatment.

”There is a need for 80% of the population of this country to have clarity of application of the legal system which is central to them forming new relationships of marriage. The legal system must enable them to practise their custom of customary marriage without the uncertainty of what the various legal precedents are creating in their customary marriages,” Tsambo states in his Constitutional Court papers, which he also filed on behalf of HHP’s son Leano Khanye.

Tsambo senior is challenging the South Gauteng High Court and the Supreme Court of Appeal’s (SCA’s) decisions to recognise Johannesburg events co-ordinator and publicist Lerato Sengadi, for whom lobola was paid, as HHP’s wife. This is despite, according to HHP’s father, Sengadi not having been handed over to her purported in-laws in Mahikeng and a lamb or a goat slaughtered, and its bile used to cleanse the couple as is the custom.

n November 2018, South Gauteng High Court Judge Ratha Mokgoatlheng recognised Sengadi as the customary law wife but dismissed her bid to interdict Tsambo from burying his son, whose real name was Jabulani Tsambo, and declaring that she was entitled to bury HHP who committed suicide in 2018.

Tsambo challenged the high court’s decision at the SCA but his appeal was dismissed in April last year.He now seeking leave to appeal and set aside both Judge Mokgoatlheng and the SCA’s rulings.

”In terms of custom subsequent to the lobola negotiations and an initial payment of the lobola has been made, a date is set where the bride’s family will hand over or deliver the bride to the groom’s family.

“This is called ‘go gorosa ngwetsi (taking the bride to her in-laws)’. Upon arrival at the groom’s family, a lamb or goat will be slaughtered with the bile from the slaughtered animal being used to cleanse the couple,” Tsambo maintained in his Constitutional Court papers.

According to Tsambo, it is only afterwards that the couple is considered married and a celebration then starts, with lamb or goat meat consumed by both families.

He said in Sengadi and HHP’s case the ritual of the handover did not take place and this would have signified the couple’s union as well as the joining of the two families.

Sengadi maintains the celebrations that took place at her mother’s house in Dube, Soweto, in February 2016 on the day of the lobola negotiations constitute the handing over ceremony.

She also denies Tsambo’s assertion that the matter affects virtually all black South Africans and added he has no prospects of success.

”The applicant’s (Tsambo’s) complaint that the SCA judgment has created uncertainty as to what constitutes a valid customary marriage is wholly unsustainable in light of the clearly established authority of this court … The applicant has attempted to recast his case in this application. This is not only impermissible, but also devoid of merit,” Sengadi said.

Busiswa dragged for her awful rapping skills

When musician and performer Busiswa Gqulu made it as the only female artist on the “MTV Base Hottest MCs” list, many people came to her defense looking for reasons as to why she probably deserved it. When Cassper shared the behind the scenes of the making of Nokuthula on his docuseries titled A.M.N Sessions, the timeline became a mess. This takes us back to the time when people came up with hilarious punchlines in order to mock Faith Nketsi after she released an album.

In Busiswa’s case, she got featured on a trap/drill song where she had to lay down a verse or two. Despite her not being a rapper, she killed her verse. However when Cass shared their studio session on his YouTube channel, many could not help but feel disrespected, trolled or simply laugh at how Cass hyped Busiswa’s verse.

Busiswa

“Busiswa : “they call me Pastor Lorch coz ngiThembinkosi

Cassper : Yuuuuuu”

“Busiswa: when I cook the food change color

Cassper: yhoo”

“Busiswa: I put a dawn on my body yes I’m lotion

Cassper: killer”

She is not a rapper after all people so cut her some slack!

When she made it on the MTV Base Hottest MC’s list, she too was in disbelief. She could not help but respond to people who shaded her for making it on the list, “Artists’ Managers making it personal. The game is the game. We know they do this to get the people riled up. Let’s do impactful sh*t together rather than shade each other over lists & awards. ESPECIALLY women. We’re all we’ve got. It’s all entertainment to them. Bayahleka”

“If you are a female rapper in South Africa I hope you know they have deliberately disrespected you and chose clickbait instead: me! I am also being used here. The token female (MC) that will get engagement on social media going. I have worked my ass off for 9 years only to be made a token!”

She also dragged people who mocked her for the feature, “You can’t tell me what I know about myself. Being called a rapper is not an achievement to me. No matter how highly YOU think of it. Rest mfethu.”
